La nueva Ley Hipotecaria

Abstract

RESUMEN: El presente trabajo tiene por objeto analizar la Ley 5/2019, de 15 de marzo, reguladora de los contratos de crédito inmobiliario, es decir, la nueva redacción de la Ley Hipotecaria. Se distribuye en distintos puntos, tratando las circunstancias que han llevado a una nueva legislación sobre esta materia, identificando las causas del retraso que demoró a la Ley hasta que entró en vigor. Explicando las claves que se deben estudiar para entender las modificaciones; como la ejecución hipotecaria, la tasación, la hipoteca verde, entre otras. De la misma manera, se observan las ventajas que producen al cliente, ventajas que se han establecido, en gran parte, por diversas sentencias dictadas por el Tribunal de Justicia de la Unión Europea al amparo de la legislación comunitaria.

ABSTRACT: The aim of this essay is to analyse the Law 5/2019 from the fifteenth of march, which regulates real estate credit contracts, commonly known as the new Mortage Law. It is going to be divided into several sections, identifying both the circumstances that made this new legislation posible, and the reasons that caused the delay of the law´s approval. This essay Will also highlight the key concepts that need to be studied in order to understand some modifications, such as foreclousure, valuation or the green mortage. At the same time, it Will focus on the advantages for the client, that have been incorporated majorly due to the judgements coming from the European Union´s legislation
