Derecho a la propia imagen tras la entrada en vigor de la Ley orgánica 5/2010

Abstract

RESUMEN: El presente trabajo tiene como objeto el estudio del derecho a la propia imagen y las novedades introducidas por la LO 5/2010 en la LO 1/1982. Para ello, se ha dividido el trabajo en dos partes, una primera parte, en la que se desarrolla el concepto, contenido, ámbito y límites del derecho a la propia imagen desde un punto de vista esencialmente jurisprudencial; y una segunda parte, en la que se contrasta la regulación del derecho antes y después de las modificaciones introducidas por la LO 5/2010, concluyendo que la modificación mas sustantiva es la introducción de una nueva medida de tutela judicial consistente en la apropiación por parte de la víctima del lucro obtenido por la intromisión ilegítima.

ABSTRACT: This essay has as its main objective the study of the right to self-image and the changes introduced by the LO 5/2010 in the LO 1/1982. With this purpose, the essay is split in two parts: the first one develops the concept, content, scope and limits of the self-image right from a essentially jurisprudential point of view; Within the second part, a comparison on the regulatory environment before and after the amendments brought out by the LO 5/2010, concluding that the most substantive change is the introduction of a new legal protection measure involving the appropriation by the victim of the profit obtained by trespass.
