El proceso soberanista ante el Tribunal Constitucional

Abstract

RESUMEN. El presente trabajo pretende analizar de forma crítica la jurisprudencia del Tribunal Constitucional sobre el proceso independentista catalán. Desde que comenzara dicho proceso en el año 2012, el Alto Tribunal ha realizado más de treinta pronunciamientos, lo que diferencia a España de otros modelos constitucionales donde también se han producido problemas secesionistas. Los argumentos del Tribunal van desde una posición de apertura (STC 42/2014), donde se pretendía crear un marco constitucional para el desarrollo del derecho a decidir, a posiciones menos transigentes, consecuencia del carácter unilateral que adopta el proceso separatista. Es destacable, también, las pocas variaciones que ha sufrido su doctrina en aspectos clave como los límites a la reforma constitucional o las obligaciones derivadas de la lealtad constitucional.

ABSTRACT. This paper aims to analyze the jurisprudence of the Constitutional Court on the Catalan independence process. Since the beginning of this process in 2012, the Court has made more than thirty pronouncements. This differentiates Spain from other constitutional models where secessionist problems have also occurred. The Court's arguments range from a position of openness (STC 42/2014), where the intention was to create a constitutional framework for the development of the right to decide, to less compromising positions, as a consequence of the unilateral nature of the separatist process. It is also remarkable the few variations that its doctrine has suffered in key aspects such as the limits to the constitutional reform or the obligations derived from the constitutional loyalty.
