Prostitución y trata de seres humanos con fines de explotación sexual

Abstract

RESUMEN: El principal objetivo de este trabajo es demostrar la relación entre prostitución y trata de seres humanos a través de la Historia. En primer lugar, se ha realizado un acercamiento a la realidad actual de la trata de personas, aportando datos y cifras para poder entender el contexto en el que nos situamos. Luego se lleva a cabo una delimitación de conceptos que suelen dar lugar a confusión y sobre los que versa el trabajo: prostitución y trata de personas con fines de explotación sexual. ¿Es el trabajo más antiguo del mundo o una forma de violencia contra las mujeres? A continuación, se detalla la evolución de la prostitución a lo largo de la Historia, desde la Edad Antigua hasta la actualidad. Se hace un recorrido a través del tratamiento que recibe en los distintos momentos históricos, que se refleja en sus respectivas legislaciones. Después se comentan varias sentencias de interés para comprender mejor cómo actúan los tribunales ante este fenómeno. Por último, una reflexión: ¿por qué sigue existiendo la prostitución? Se aborda la influencia de teorías como el neoliberalismo como explicación a la mercantilización de los cuerpos de las mujeres y a la feminización de la pobreza. Para finalizar, es el momento de posicionarse entre regulacionismo o abolicionismo y hacer algunas propuestas.

ABSTRACT: The main objective of this work is to prove the relation between prostitution and human trafficking through History. To begin with, a first approach to the current reality of the human trafficking has been made by providing data as well as figures to understand the context where we are. Then, I found helpful to explain some concepts that usually cause confusion and which the work is about: prostitution and human trafficking for sexual exploitation. Is it the oldest job of the world or a violence against women? Next, the evolution of prostitution is explained through History, from Antiquity to the present. We make a historical tour of the treatment of prostitution in every historical period that appears on the different laws. Moreover, a few interesting sentences are commentated in order to better understand the way the courts act with this issue. Considering all this, a reflection: Why does prostitution still exist? The influence of theories such as neoliberalism is told as an explanation for the commercialization of women's bodies and the feminization of poverty. To conclude, it is the time to take a stance between regulationism and abolitionism and to make some proposals.
