Consideraciones generales sobre la violencia de género: especial atención a los hijos menores de las víctimas

Abstract

RESUMEN: El presente trabajo tiene como fin principal realizar un estudio del concepto de violencia de género, así como intentar dar respuestas tanto desde el punto de vista del Derecho internacional, como del Derecho nacional, a este fenómeno tan presente en nuestra sociedad. Por un lado, se analiza el origen de este concepto de violencia de género y sus características propias que la diferencian de la violencia doméstica, así como su evolución al entrar en vigor la Ley Orgánica 1/2004, de 28 de diciembre. A continuación, se recogerán aquellos preceptos que regulan de algún modo su constitucionalidad, los derechos de las víctimas y los principios de igualdad y no discriminación. Por último, se analizarán los efectos de la violencia de género en niños y adolescentes, los tipos de violencia que existen, la evolución de la normativa en esta materia y las propuestas de ley con las que contamos actualmente.

ABSTRACT: The main purpose of this work is to carry out a study of the concept of gender violence, as well as to try to give answers from the point of view of international law and from the point of view of national law also, to one of the most important problems in our society. On the one hand, it analyzes the origin of this concept of gender violence and its own characteristics that difference it from domestic violence, as well as its evolution when Organic Law 1/2004, of December 28, started. Next, I will collect the precepts that regulate in some way the constitutionality of the organic law, victims’ rights and the principles of equality and non-discrimination. Finally, I will analyze the effects of gender violence in children and adolescents, the types of violence that exist, the evolution of rules in this área and the proposed laws that we currently have.
