Secuestro internacional de menores: caso Juana Rivas

Abstract

El Secuestro Internacional de Menores se ha convertido en una realidad social acuciante, que involucra a varios Estados pertenecientes o no a la Unión Europea, por lo que se han creado mecanismos internacionales para su regulación, con la finalidad de combatir este fenómeno, el cual aumenta año tras año. En este trabajo se analiza la diversa normativa internacional, poniendo énfasis en el supremo interés del menor y la necesidad de protegerlo, así como la jurisprudencia ceñida al caso “Juana Rivas”.

The international abduction has become a pressing social reality, which involves several states belonging or not to the European Union, so that international mechanisms have been created for its regulation, in order to combat this phenomenon, which increases year after year. This paper analyzes the diverse international regulations, emphasizing the supreme interest of the child and the need to protect him, as well as the jurisprudence attached to the Juana Rivas`case.
