Abstract

RESUMEN: Por medio de la contextualización histórica, se realiza un enfoque práctico sobre la situación de violencia vivida en torno al deporte durante décadas. Dicha violencia pretende ser paliada por medio de distintas medidas preventivas y de disuasión, siendo pionera la llegada del Convenio Europeo de Estrasburgo en 1985. En España, se crea la Ley 10/1990, de 15 de octubre, la cual es desarrollada por distintos reglamentos. Al quedarse obsoleta en varios aspectos, es renovada y ampliada por la Ley 19/2007, de 11 de julio, contra la violencia, el racismo, la xenofobia y la tolerancia en el deporte, la cual es el objeto principal de análisis en este trabajo. Se estudia su funcionamiento y aplicación, realizando un especial hincapié en la prevención del racismo, la xenofobia y la intolerancia en los campos de fútbol, destacando la importancia que actualmente tiene la Comisión Antiviolencia en España. Por medio de la jurisprudencia aportada, se analizan diversos casos mediáticos y relevantes, donde se contraponen diversos puntos de vista, en base a la citada Ley. Así mismo, se trata de referenciar la duplicidad de órdenes que se generaría cuando un hecho teóricamente ilícito es enjuiciado tanto por la disciplina administrativa deportiva, como por la penal. Por último, se realiza una breve exposición de la Ley y situación en Italia, llegando a comparar ciertos aspectos que se contraponen a lo existente en nuestro país.

ABSTRACT: By means of historic contextualization we make a practical approach about the situation of violence existing around sport for decades. Such a violence is aimed to be mitigate by means of several preventive and deterrent measures, considering pioneering the European Convention of Strasburg in 1985. In Spain , a law 10/1990 is passed in October 15th, this is developed by several regulations .Becoming outdated in different aspects it is reissued and extended with the law 19/2007 July 11th against violence, racism , xenophobia and tolerance in sport which is the main analysis aim of this thesis. We study its function and application with a special stress in prevention against racism, xenophobia and intolerance in football pitches, outlining the importance nowadays of the Antiviolence Commission in Spain. By means of the jurisprudence contributed, we analyse some of the most interesting media cases where different points of view are achieved, based upon the mentioned Law. Also, we try to make reference to the duplicity of orders which is created when an illegal fact is judged both by the administrative sport discipline and the criminal. Finally, a brief statement of this situation in Italy is compared with some aspects which are different from the existing one in our country.
