Incidencia de la robótica en las relaciones de trabajo

Abstract

RESUMEN: El presente trabajo de investigación versará sobre los diferentes problemas que la robótica puede causar en el futuro del empleo. El principal problema que puede dar la robótica en el futuro del empleo es la sustitución de los seres humanos por los propios robots, por lo tanto, el objetivo de este trabajo será dar una respuesta a ese problema. Además, en este trabajo de investigación se tendrá en cuenta el contexto histórico para saber cómo hemos llegado a esta situación, así como también se tendrá en cuenta los problemas jurídicos que puede suponer esta industria 4.0 en el mercado laboral y se abordarán las posibles soluciones al problema, teniendo en cuenta la viabilidad de las mismas. Abordaremos el contexto histórico desde las revoluciones industriales hasta el uso del primer robot en un puesto de trabajo. También deberemos tener en cuenta la definición de robot, por lo que será necesario precisar a qué nos referimos exactamente con robot, pero descartando en este trabajo el estudio de la Inteligencia Artificial(IA), que si bien es importante en esta industria 4.0 no podemos abarcar en este trabajo el estudio de esa materia, ya que si no la extensión de este trabajo sería demasiado grande. También veremos los diferentes problemas jurídicos que plantea la robótica desde un punto de vista estrictamente laboral, por lo que nos centraremos más en el despido que en cualquier otro problema que plantee la robótica en el mundo laboral, en especial abordaremos la institución del despido por causas económicas, técnicas y organizativas. En este apartado referido al derecho también veremos la responsabilidad por los posibles daños que puedan producirse por los robots en el ámbito laboral. Por último, estudiaré las posibles soluciones al problema, teniendo en cuenta que algunas de ellas ya han sido propuestas por otros autores, así como otras más originales.

ABSTRACT: The present research work will be about the diferent problems that robotics may cause in the future of employment. The main problem which robotics may give in the future of employment is the replacement of human beings by the robots themselves, therefore, the objective of this work will be to give an answer to this problem. Furthermore, in this research work the historical context will be taken into account to know how we have reached this situation, as well as it will be consider the legal problems that this industry 4.0 may involve in the labour market and the posible solutions to the problema will be addressed, considering their viability. We will address the historical context from the industrial revolutions until the use of the first robot in a job. We should also consider the definition of robot, so it will be necessary to specify what we mean by robot exactly, but discarding in this work the study of Artificial Intelligence (AI), although it is important in this industry 4.0 we cannot include the study of that matter in this work, otherwise the extensión of this work would be too large. We will also see the different legal problems that robotics poses from a strictly labour point of view, so we will focus more on dismissal than in any other problem posed by the robotics in the labour world, we will address the institution of dismissal for economic, thecnical and organization reasons especially. In this section referring to the law we will also see the responsability that can be produced by robots in the workplace. Finally, i will study the posible solutions to the problema, considering that some of them have already been proposed by other autors, as well as more original ones.
