Abstract

RESUMEN: El recargo de prestaciones por falta de medidas de seguridad del empresario pretende reparar un daño a un trabajador que ha sufrido un accidente de trabajo o enfermedad profesional a través del incremento económico de la prestación a la que tiene derecho dicho trabajador de la Seguridad Social. Para ello tiene que existir un nexo causal entre el daño ocasionado al trabajador y la falta de medidas de seguridad del empresario. La responsabilidad de dicho recargo recaerá directamente sobre el empresario infractor, aunque nos podemos encontrar con situaciones especiales en las que existe una pluralidad de empresarios, y hay que atender a cada caso concreto

ABSTRACT: The increase of benefits of the infraction of the security measures by the employer is intended to repair the damage to a worker who has suffered a work-related injury or occupational disease through the economic increase in the benefit to which such a worker is entitled to the social insurance. In order to do this there has to be a casual link between the damage caused to the worker and the lack of security measures for the employer. The responsability for the surcharge will fall directly on the offending employer, although we can find with particular situation where there is a plurality of employer, and deal with each specific case
