Aspectos básicos de prevención de riesgos laborales: sector del metal

Abstract

RESUMEN: En este trabajo lo que se pretende es estudiar los diferentes riesgos que derivan de las funciones propias de los trabajadores dentro de este sector, así como analizar las diferentes medidas de seguridad que se deben aplicar para poderlas evitar. Dentro del sector del metal en su amplio sentido de la palabra, vamos a centrarnos, sobre todo, en el sector de la conformación del metal, utilizando como caso práctico de estudio, un accidente en una fábrica dedicada a la fundición, que es una de las prácticas que se emplean dentro de este sector. El no uso de estas medidas por parte del trabajador, así como la falta de información, aplicación y facilitación por parte del empresario para que se lleven a cabo, va a ser decisivo a la hora de decidir quién es el responsable del accidente de trabajo. Más adelante se explican las diferentes obligaciones por parte del empresario y por parte del trabajador, donde se va a aclarar en qué medidas serán responsables unos u otros, y en que se van a basar a la hora de crear jurisprudencia al respecto. Vamos a desglosar las diferentes etapas del sector del metal, centrándonos en el conformado del metal, sobre todo, valorando tanto los riesgos como las medidas preventivas para poderles evitar, además de hacer un breve resumen de cada una de ellas, indicando las funciones y la forma de trabajar. Día a día, la evolución tecnológica se ve presente en todos los ámbitos de la vida, no siendo menos en el ámbito laboral, por lo que las empresas deben ir actualizándose a la vez que lo va haciendo el mercado para no quedarse obsoletas. En la actualidad, se está haciendo un estudio de mercado para valorar la conversión del sector metalúrgico español a industria 4.0, por lo que se tendrán que actualizar, tanto las medidas a implantar por las empresas como las leyes y convenios en los que actualmente nos regimos actualmente en este sector.

ABSTRACT: In this work, the aim is to study the different risks arising from the functions of workers within this sector, as well as to analyze the different security measures that must be appl ied in order to avoid them. Within the metal sector in its broad sense of the word, we are going to focus, above all, on the metal forming sector, using as a case study, an accident in a factory dedicated to f oundry, which is one of the practices used of this sector. The non- use of these measures by the worker, as well as the lack of information, application and facilitation by the employer to carry them out, will be decisive in deciding who is respo nsible for the accident at work. The various obligations on the part of the employer and on the part of the worker are ex plained below, which will clarify on which measures will be responsible for one or the o ther, and on which they will be based on the creation of case-law in this regard. We will break down the different stages of the metal sector, focusing on the forming of t he metal, above all, assessing both the risks and the preventive measures to be able to av oid them, in addition to making a brief summary of each of them, indicating the functio ns and how to work. Every day, technological developments are present in all walks of life, not least in the fi eld of work, so companies must be updated while the market is doing so as not to beco me obsolete. Currently, a market study is being carried out to assess the conversion of the Spanish m etallurgical sector to Industry 4.0, so the measures to be implemented by companies and the laws and conventions in which we are currently we currently rule in this sector.
