El objetivo principal de este trabajo es profundizar en el conocimiento de la regulación dada por la Unión Europea a las transferencias internacionales de datos. Para ello se tomarán como referencia la Directiva 95/46/CE y el posterior Reglamento General de Protección de Datos. Compararemos ambas normas con el propósito de identificar las modificaciones introducidas por el Reglamento en el tratamiento de las transferencias, y comentar sus implicaciones desde la perspectiva del equilibrio entre la protección de datos personales y el mantenimiento del flujo internacional de datos.
ABSTRACT:The main goal of this paper is to acquire a deeper knowledge of the European regulation with regard of international personal data transfers. In order to do that, we would take as reference the Directive 95/46/CE and the EU General Data Protection Regulation. We would compare both regulations with the purpose of identify the regulatory amendments made by the GDPR on the treatment of personal data transfers, and to comment their impact from the perspective of the equilibrium between personal data protection and international personal data flows.
