Análisis de la regulación del mercado financiero y coordinación con la regulación europea

Abstract

RESUMEN: En el presente trabajo vamos a realizar un análisis de la regulación que al mercado financiero compete, así como un enfoque de la coordinación con la regulación europea. El objetivo de este es exponer las competencias de las instituciones que intervienen en dicho mercado. El sistema financiero, y por tanto el mercado financiero, es un sistema muy amplio y un tanto complejo que espero se facilite su comprensión cumpliendo con el objetivo final de este trabajo. Además de la repercusión que las actuaciones de las entidades reguladoras generen, vamos a analizar también las responsabilidades y obligaciones que las personas físicas y jurídicas adquieren en este ámbito. Durante los periodos de crisis hemos podido ver como se han ido endureciendo algunas de las normas que intervienen en materia financiera tanto en Europa como en España. El Banco Central Europeo y el Banco de España han tomado un papel importante en la historia del mercado financiero y es interesante conocer su campo de actuación, así como la repercusión de las políticas que estos puedan aplicar. Los cambios en algunas normativas o las nuevas regulaciones incorporadas al mercado, habitualmente de carácter restrictivo, conllevan un periodo de adaptación y conocimiento para el conjunto de la sociedad. No siempre son aceptadas con entusiasmo, especialmente si son de carácter restrictivo, y aunque no solo por ello se debe regular la buena aplicación de estas y colaborar así al buen funcionamiento de la economía.

ABSTRACT: In this paper we will carry out an analysis of the regulation that corresponds to the financial market, as well as an approach to coordination with European regulation. The aim of this is to set out the competences of the institutions involved in that market. The financial system, and therefore the financial market, is a very broad and somewhat complex system that I hope will be facilitated by achieving the ultimate objective of this work. In addition to the impact that the actions of the regulatory entities generate, we will also analyze the responsibilities and obligations that natural and legal persons acquire in this area. During the periods of crisis, we have seen some of the rules involved in financial matters in both Europe and Spain tightened. The European Central Bank and the Bank of Spain have played an important role in the history of the financial market and it is interesting to know their field of action, as well as the impact of the policies they can implement. Changes in some regulations or new regulations incorporated into the market, usually of a restrictive nature, entail a period of adaptation and knowledge for the whole society. They are not always accepted with enthusiasm, especially if they are restrictive in nature, and although it is not only for this reason that the good application of these must be regulated and thus contribute to the proper functioning of the economy.
