RESUMEN: La ludopatía se configura como uno de los problemas principales de la sociedad, teniendo incidencia en el plano jurídico. En este trabajo el objeto de análisis es estudiar cómo afecta a la sociedad gananciales las deudas contraídas por un cónyuge jugador. El estudio muestra la diferencia entre los juegos permitidos e ilícitos y la incidencia que tienen en los artículos 1.371 y 1.372 del Código Civil. El objetivo fundamental es exponer los problemas del cónyuge no jugador, los mecanismos de defensa que posee y de qué forma se ve afectado el régimen de gananciales.
ABSTRACT: Pathological gambling is one of the main problems of society, having an impact on the legal level. In this work, the object of analysis is to study how the debts incurred by a player spouse affects society. The study shows the difference between permitted and illicit games and the impact they have on articles 1,371 and 1,372 of the Civil Code. The fundamental objective is to expose the problems of the non-player spouse, the defense mechanisms that he possesses and in what way the property regime is affected.
