Derecho penal y víctima: víctimas de acoso laboral

Abstract

RESUMEN: En este trabajo analizaremos el papel que ha desempeñado la víctima del delito a lo largo de la historia y el redescubrimiento que ha tenido ésta en los últimos años. Como consecuencia de este último acontecimiento, veremos el trato que recibe la víctima en la actualidad dentro de nuestro Ordenamiento Jurídico, haciendo referencia a los derechos y a la protección de la que ahora dispone. A pesar de hablar de la víctima en general, nos centraremos en las víctimas del delito de acoso laboral, delito introducido recientemente en nuestro Ordenamiento Jurídico, con la reforma de la LO 5/2010. Examinaremos los elementos necesarios para la consumación del delito de acoso laboral. Para finalizar abordaremos un análisis jurisprudencial de las últimas sentencias dictadas en España durante los años 2017 y 2018.

ABSTRACT: This paper will analyze the role that has become the victim of crime throughout history and the rediscovery that has taken place in recent years. As a result of this last event, we will see the treatment that the victim will receive at the present time in our Legal Order, making reference to the rights and the protection that he or she now has. Despite talking about the victim in general, we will focus on victims of labor crime, in the Legal Order, with the reform of Organic Law 5/2010. We will examine the elements necessary for the perpetration of the crimen of workplace harassment. Finally, we will address a precedent analysis of the latest sentences handed down in Spain during the years 2017 and 2018.
