La adopción y el derecho a los orígenes del hijo adoptivo

Abstract

RESUMEN: El presente trabajo tiene como objeto hacer un estudio detallado sobre la adopción, una figura olvidada a lo largo de la historia y que no es regulada en nuestro ordenamiento jurídico hasta el siglo XIX. Existiendo hoy en día diferentes sistemas de adopción, destacando entre ellas, la adopción abierta, recientemente implantada legalmente en nuestro país y se caracteriza por la ruptura del anonimato de los padres biológicos. También se hablará de los efectos de la adopción sobre la familia de origen y la familia adoptiva y, más concretamente, sobre el derecho del adoptado a conocer su filiación de origen. Esta cuestión siempre ha sido fruto de diversos conflictos, desde un punto de vista tanto ideológico como político y jurídico. Además, se mencionará las diferentes medidas que han sido implantadas en el derecho del adoptado para conocer su filiación de origen, partiendo de unas medidas restrictivas a una mayor apertura en los últimos años. También se hará referencia a su desarrollo legislativo tanto a nivel nacional como internacional, siendo recogido este derecho en diferentes convenios internacionales, y su regulación en el derecho comparado.

ABSTRACT: The purpose of this paper is to make a detailed study about adoption, a figure forgotten throughout history and that is not regulated in our legal system until the nineteenth century. Today, there are different adoption systems, standing out among them, the open adoption, recently introduced legally in our country and characterized by the breakdown of the anonymity of biological parents. The effects of the adoption on the family of origin and the adoptive family will be discussed too, and, more specifically, the right of the adoptee to know his parentage of origin. This issue has always been the result of various conflicts, from an ideological, political and legal point of view. Besides, the different measures will be mentioned that have been implemented in the right of the adopted to know their filiation of origin, starting from restrictive measures to a greater openness in recent years. It will also make reference to its legislative development both nationally and internationally, this right will be included in different international conventions, and its regulation in comparative law.
