El derecho de residencia de los progenitores nacionales de terceros estados en la Unión Europea: el caso “H.C. Chávez-Vílchez y otros”

Abstract

RESUMEN: El presente TFM tiene por objeto un tema de especial relevancia en la jurisprudencia reciente del Tribunal de Justicia de la Unión Europea, destacando su sentencia en el caso H.C. Chávez-Vílchez y otros, de 10 de mayo de 2017. En dicha sentencia se considera el derecho de residencia de los progenitores de ciudadanos de la Unión a la luz del principio del interés superior del menor y otros principios de derechos humanos. El tema se enmarca en el concepto de ciudadanía de la Unión e, indirectamente, en el ejercicio de la competencia de la Unión Europea en materia de inmigración, y será abordado en la perspectiva del control jurisdiccional que realiza el Tribunal de Justicia de la Unión Europea en relación con estos derechos.

ABSTRACT: The present master dissertation considers an issue of relevance, in the recent precedent to the Court of Justice of the European Union, highlighting its ruling in case “H.C. Chavez-Vilchez, and other, of may 10, 2017”. In this judgment, the right of residence of the parents of a European Citizen Child`s is considered in the light of the principle of the highe interes of the minor, as well as other principles of the human rights. This matter is set within the exercise of competence of the European Union in the field of immigration and will be addressed from the perspective of the jurisdictional control, carried out by the European Union Court of Justice.
