RESUMEN: El trabajador autónomo económicamente dependiente es una figura creada para la protección de un colectivo que antes no disfrutaba de amparo legal, ya que, aunque tenía claras peculiaridades que le diferenciaban del trabajador autónomo clásico, eran considerados como autónomos.
Con la inclusión de esta figura en la Ley 20/2007, reguladora del Estatuto del Trabajo Autónomo, se empieza a tener en cuenta la dependencia económica de estos trabajadores hacia un único cliente, denominado cliente principal, del que percibe al menos el 75 % de sus ingresos.
La LETA y el RD 197/2009 establecen cuál es su definición legal y los rasgos que le diferencian del trabajador autónomo clásico y del trabajador por cuenta ajena, además de regular su régimen profesional.
La elaboración de este trabajo ha sido enfocada al estudio de la normativa y de la doctrina jurisprudencial que concierne al TRADE.
ABSTRACT: The economically dependent self-employed is a figure created for the protection of a group that previously had no legal protection, which already had clear the peculiarities that differentiated it from the classic self-employed, were considered as self-employed.
With the inclusion of this figure in Law 20/2007, which regulates the Autonomous Work Statute, the economic alternative of these workers to a single client, known as the principal client, is considered, from which he receives at least 75% of his income.
The LETA and the RD, 197/2009, establish its legal definition and the features that differentiate it from the classic self-employed and the employed worker, in addition to their professional regulations.
The elaboration of this work has been focused on the study of the law and jurisprudential doctrine that concerns the TRADE.
