Acción de responsabilidad civil extracontractual por accidentes de transporte colectivo de pasajeros en carretera

Abstract

RESUMEN: Este TFG analiza, de manera conjunta, la evolución de la doctrina y la jurisprudencia referente a la responsabilidad civil extracontractual, con el hecho real del accidente de autocar ocurrido en Freginals (Tarragona) en el que murieron 13 universitarias y 28 resultaron heridas. Se estudiará el régimen jurídico aplicable en el transporte terrestre de pasajeros, en este caso, con la existencia de un elemento extranjero, determinando cuando correspondería ejercitar una acción de responsabilidad contractual y cuando la extracontractual. Además, se expondrá una posible solución aplicando el nuevo baremo de daños

ABSTRACT: This TFG analyzes together, the evolution of doctrine and case law concerning tort liability, in actual fact the bus accident occurred in Freginals (Tarragona) in which 13 university died and 28 were injured. The legal regime applicable in the land transport of passengers will be studied, in this case, with the existence of a foreign element, determining when it would be appropriate to exercise an action of contractual liability and when extracontractual. In addition, a possible solution will be exposed by applying the new damage scale.
