Control de los reglamentos en el ordenamiento jurídico español

Abstract

El reglamento es una disposición normativa dictada por el Poder Ejecutivo, lo que implica una relación de subordinación con la Ley, esta relación de subordinación tiene una doble significación: que su contenido, alcance y procedimiento no pueden contravenir lo previsto en la Ley y tampoco podrán existir reglamentos sin una Ley previa habilitante, con la excepción de los reglamentos independientes. Por requerimiento de los valores constitucionales, que consagran el Estado de Derecho, la subordinación del Reglamento a la Ley ha de ser controlada por los órganos jurisdiccionales, este control es el objeto de estudio de este trabajo.

The regulation is a regulatory provision issued by the Executive Power; this implies a relationship of subjection with the Law, this relationship of subjection means two things: its content, scope and proceedings cannot contravene the Law and it also means the nullity of regulations that exist without a previous and enabling Law, except independent regulations which are an exception. In order to fulfill the requirements of constitutional values, which establish the rule of Law, the subjection of regulations to Law should be controlled by the jurisdictional organs; this control is the object of study of this work.
