La evolución feminista del derecho

Abstract

RESUMEN: El principal objetivo de este trabajo es demostrar la influencia del feminismo en el Derecho a lo largo de los diferentes momentos de la Historia. En primer lugar, se ha comentado la desigualdad que sigue existiendo desde la Antigüedad hasta la actualidad, para poder entender el contexto en el que se sitúa el feminismo. Luego, se aclaran los siguientes conceptos: patriarcado, distinguiendo el de coerción y el de consentimiento, sexo y género, todos tan en boga hoy en día. A continuación, se detalla la evolución del movimiento feminista, así como los avances logrados por fenómenos clave como el sufragismo y las principales declaraciones tras la Segunda Guerra Mundial para lograr la igualdad. Se hace un recorrido histórico de la discriminación de la mujer en España, que aparece reflejado en las diversas Constituciones, Códigos Civiles y Códigos Penales. En la segunda parte del trabajo, se aborda la participación política de la mujer en nuestro país, desde el reinado de Alfonso XIII, la II República y la dictadura franquista hasta la etapa constitucional. Aunque la presencia de la mujer en el ámbito público es un hecho, sigue sin ser suficiente. Esta es la razón por la que los Poderes Públicos toman medidas tan polémicas como la Ley de Cuotas se realiza una comparativa con otros países y se debate la necesidad de mecanismos tan polémicos como la Ley de Cuotas. Como conclusión, se debate la necesidad de estas medidas y se compara con las líneas de actuación de otros países que tratan de lograr la igualdad real entre hombres y mujeres.

ABSTRACT: The main objective of this work is to prove the influence of feminism in Law through history. First, it has been told the inequality that exists from the antiquity to the present in order to understand the context where the feminism is in. Then, I found it helpful to explain the next concepts: patriarchy- speaking of the difference between the coercion and the consent one-, sex and gender, taking into account that all of them are hot news. Next, the evolution of the feminist movement is explained, as well as the advances managed thanks to organizations like the suffragettes, and the most important bills of rights after the II World War which were focused on achieve the equality. We can take a historical tour of the discrimination of women in Spain that appears on the different Constitutions, Civil Codes and Penal Codes too. In the second part of this work, the political participation of women in our country is told, from the reign of Alfonso XIII, the II Republic and the Franco’s dictatorship to the constitutional period. Besides the fact that women are in the public sphere, it is still insufficient. This is the reason why Public Authorities take polemical measures such as the “Quotas Law”. To conclude, the needed of the measures is discussed and also compared with the courses of action from other countries to attain the real equality between men and women.
