RESUMEN: A través de este TFG se pretende ahondar en el origen y aplicación, así como el por qué de los requisitos de esta prestación. Se pretende indagar en el fondo de la prestación desde, como se ha mencionado anteriormente, su principio, hasta el interior de los fundamentos, el por qué de la poca accesibilidad de los progenitores con hijos con enfermedad grave.
Relevante es el hecho de los requisitos tan exhaustivos y las inclusiones de las enfermedades que están protegidas y cuales no lo están. Siguiendo la línea de investigación del por qué del surgimiento de esta prestación, resulta necesario compararla con la reducción de jornada por cuidado de hijos menores de 12 años.
Destacables son las diferencias y similitudes entre la prestación por cuidado de menores gravemente enfermos y la citada reducción de jornada. ¿A caso no es relevante resaltarlo cuando las dos son reducciones de jornada por cuidado de hijos? ¿Por qué una da derecho a una prestación económica y la otra no? De aquí la importancia de, como antes hemos mencionado, entrar en el fondo del origen de esta prestación de tan difícil acceso.
Basando este Trabajo Fin de Grado en estas líneas, se recabará también información acerca de la jurisprudencia existente y el porqué de dicha jurisprudencia.
ABSTRACT: Through the TFG it’s pretend to go deeper in the origin and enforcement, also the why of the requirement of this innovational benefit. It’s pretend to inquire in the depth of this benefit from, how it was mentioned anteriorly, its starting, until the interior of the fundaments, why there is a little accessibility of the progenitors with its children having a severe disease.
Is relevant the fact of the so exhaustive requirements and inclusions of which diseases are there and which one no. Following the investigation line of why is important to recover the born and compare it to the shortening or reduction of a workday for the care of children under 12 years old.
Are remarkable the differences and similarities between the reduction benefit and just the reduction. Is it not relevant to remark when both are reductions of a day for the caring of children? Why one benefit yes and the other one no? Here it’s seen the importance of, how we mentioned during the last paragraphs, investigating the background of born, of this innovational benefit with such difficult access.
Basing this report of final grade in this lines it will also be collected the information about the existent law and why is applied this law.
