La retroactividad en las sentencias del Tribunal Constitucional

Abstract

RESUMEN: A lo largo de este trabajo se verán sentencias del Tribunal Constitucional que, en mayor o menor medida, han arrojado luz sobre el articulo 9.3 de la Constitución. En este artículo se proclama el principio de irretroactividad de las disposiciones sancionadoras no favorables o restrictivas de derechos individuales y también, entre otros, el principio de seguridad jurídica. Principio éste sin el cual no tendría sentido hablar de la irretroactividad pues deriva y tiene como objetivo proteger la seguridad jurídica. Veremos cómo se interpreta y a qué supuestos afecta la prohibición de irretroactividad y todo lo que esté relacionado con la extensión de la aplicación de la norma a hechos y situaciones anteriores a su entrada en vigor.

ABSTRACT: Along this work there will be seen judgments of the Constitutional Court that, in major or less measurement, have thrown light on the article 9.3 of the Constitution. In this article there is proclaimed the beginning of nonretroactivity of the dispositions sanction not favorable or restrictive of individual rights and also, between others, the beginning of juridical safety. There began this one without which it would not make sense to speak about the nonretroactivity since it derives and takes as a target to protect the juridical safety. We will see how it is interpreted and to what assumptions it affects the prohibition of nonretroactivity and everything what is related to the extension of the application of the norm to facts and situations previous at its coming into effect.
