El caso de Abeng Ayang: el interés del menor y la responsabilidad parental en el derecho internacional privado

Abstract

RESUMEN: El estudio se centrará, partiendo del mediático caso de María José Abeng Ayang resuelto en la sentencia 88/2016 de la Audiencia Provincial de Asturias, en las figuras del interés del menor y la responsabilidad parental tanto a nivel internacional como interno, desembocando en un análisis de los conflictos legislativos que se dan a nivel de derecho internacional privado, materia que vertebra todo el procedimiento por el carácter internacional del mismo. Trataré entonces de dar respuesta, una vez entendida la situación y los conceptos jurídicos en juego, a qué Estado es competente y que legislación será la aplicable a este supuesto, analizando y sorteando las diferencias y lagunas existentes entre los diferentes instrumentos internacionales aplicables y la concepción actual de la responsabilidad parental, la adopción y sus medidas preparatorias.

ABSTRACT: The study will be focused, based on the mediatic of María José Abeng Ayang and the sentence 88/2016 judged by Audiencia Provincial de Asturias, in the figures of the interest of the child and parental responsibility both internally and internally, leading to an analysis of legislative conflicts that occur at the level of private international law, subject that leads the whole procedure by the international character of the same. I will then try to explain, once the situation and legal concepts have been understood, which state it is competent and which legislation will be applicable to this case, analyzing and bypassing the differences and gaps between the different applicable international instruments and the conception Of parental responsibility, adoption and preparatory measures.
