Estado de necesidad

Abstract

RESUMEN: El actual trabajo revisa los criterios jurisprudenciales, para la aplicación de la eximente del artículo 20.5 del Código penal, el Estado de Necesidad. Para ello, se ha realizado un exhaustivo análisis de dichos criterios jurisprudenciales y de los cuatro requisitos que se exigen, para la apreciación de la citada eximente: existencia de un mal, proporcionalidad entre mal causado y el que se trata de evitar, la situación de necesidad y la ausencia del deber de sacrificio por razón de oficio o cargo. Todo ello, a partir de un breve repaso del origen histórico y las posiciones doctrinales en torno a la naturaleza jurídica del Estado de Necesidad.

ABSTRACT: The present work reviews the case law from the excused from liability collected in article 20.5 from the Criminal Code, the Necessity. Because of that, it has been carried out an analysis from the case law and also from the four requirements that are obligatory to appreciate this exemption: the existence of evil, the proportionality between the caused evil and the one that it is trying to prevent, the necessity situation and the absence of the duty of sacrifice by the reason of office or the position. All this, apart from reviewing its historical background, its regulation and its legal nature, constitute the aim of this work.
