¿Derecho al anonimato?. Reproducción humana asistida

Abstract

RESUMEN: El anonimato del donante de gametos en la reproducción asistida, aparece regulado en el artículo 5.5 de la Ley 14/2007 sobre Técnicas de Reproducción Humana Asistida. Este anonimato lesiona derechos constitucionalmente reconocidos tales como; el Derecho a la igualdad, el derecho a la libre investigación de la paternidad y el derecho a la salud entre otros. El tribunal Constitucional en el año 1999 considero, conforme a la Constitución este derecho al anonimato, sin embargo encontramos en el derecho comparado numerosos Estados que han eliminado este derecho al anonimato preservando el interés del menor y avalando de este modo el derecho al conocimiento de la identidad biológica.

ABSTRACT: The anonymity of the donor of gametes in assisted reproduction is regulated in article 5.5 of Law 14/2007 on Techniques of Assisted Human Reproduction. This anonymity damages constitutionally recognized rights such as; The right to equality, the right to free investigation of paternity and the right to health, among others.
