El control de las empresas transnacionales en un mundo globalizado

Abstract

RESUMEN: En la actualidad, el proceso de globalización está presente y afecta a todos los ámbitos de la vida, y el ámbito jurídico no es una excepción. Este trabajo pone el foco sobre el papel de las grandes empresas transnacionales (ETN). Hablar de estas empresas es hablar de los agentes económicos privados más activos en este proceso y que más se están beneficiando de él. La actividad de las transnacionales viene condicionando, de manera fundamental, no solo los derechos laborales de los trabajadores a nivel global sino que implica impactos en todos los ámbitos de la vida. Los cambios que la globalización está suponiendo inciden igualmente en los cimientos del Sistema de Relaciones Internacionales. El desequilibrio patente entre las normas que regulan la protección de sus intereses y las que tendrían que controlar los efectos negativos que en su actividad provocan es la causa de los continuos intentos por establecer normas vinculantes para las ETN.

ABSTRACT: Currently, the process of globalization is present and affects all fields of life, and the legal field is not an exception. This work focuses on the role of the big transnational corporations (TNCs). Speaking of these companies is speaking of the most active economic private agents of this process and that are most benefiting from it. The activity of transnational corporations is fundamentally conditioning, not only labour rights of the workers worldwide, but also implies impacts in all fields of life. The 2 changes that the globalization involves are also affecting the foundations of the International Relations System. The obvious imbalance between the rules governing the protection of their interests and those which would have to control the negative effects that their activity cause is the reason of the continuous attempts to establish binding rules for TNCs.
