Consideraciones ético-legales para el uso de contenciones mecánicas y farmacológicas

Abstract

Las contenciones, tanto mecánicas como farmacológicas, han sido utilizadas a lo largo de la historia sin tener en cuenta en muchas ocasiones los derechos de los usuarios. Sin embargo, en los últimos años (en especial desde el inicio del siglo XXI) han sido muchas las instituciones y los autores que han planteado la posibilidad de reducir el uso de las contenciones al máximo, o incluso eliminarlo drásticamente (a pesar de la necesidad inexorable de esta medida en ciertas circunstancias). A pesar de este emergente cambio de mentalidad, son muchas las complicaciones que atañe la aplicación de estas iniciativas “antisujeción”: falta de protocolos a nivel institucional, comunitario y nacional, escasez de recursos económicos o deficiente distribución de los mismos, y falta de motivación y formación tanto del personal sanitario como del usuario y familia implicados. En esta reflexión ética sobre el uso de las contenciones se aborda la necesidad de elaborar unas directrices unificadas para todo el territorio español que permitan la buena práctica profesional y no vulneren los derechos éticos y morales de los usuarios.

Restraints, both physical and pharmacological, have been used throughout history without taking into account the rights of the patients. Nevertheless, for the past few years (especially since the beginning of the XXI century) many institutions and authors have considered the possibility of reducing the use of restraints or even eliminating them (even though sometimes it is impossible to avoid this measure). Despite the change of mentality, applying these “no-restraints” initiatives have many complications: the absence of protocols at an institutional, regional and national level, the shortage or deficient distribution of economic resources and the lack of motivation and training of health care professionals, patients and their families. In this ethical reflection about the use of restraints, the necessity of writing a common guideline for all the Spanish territory is addressed, so that it will be easier to be an efficient health care worker and, at the same time, no ethical or moral rights will be violated.
