El seguro marítimo y su regulación histórica en España

Abstract

RESUMEN: Desde que nació el comercio marítimo, se ha querido impulsar y, para ello, los sujetos intervinientes, mercaderes y transportistas, requerían tener una seguridad para su mercancía o para sus barcos, ya que el mar supone riesgos numerosos y elevados. A través de la búsqueda de tal seguridad se fueron creando unas figuras que protegían ese tipo de comercio, hasta que se creó la institución del seguro marítimo. A lo largo del trabajo vamos a hacer un análisis cronológico del surgimiento de esas figuras afines al seguro marítimo, de entre las que destacar los préstamos a la gruesa y las mutualidades. Una vez surge el seguro marítimo en el Mar Mediterráneo, durante este análisis vamos a comentar cómo eran esos primeros contratos y cómo los van a tratan los distintos cuerpos legales que se redacten en España, así como el contexto de los mismos. Desde las Ordenanzas de Barcelona de 1434, primera ley sobre seguros del mundo, hasta las Ordenanzas de Bilbao de 1737, que sirvieron de soporte para su regulación en nuestro ordenamiento jurídico actual.

ABSTRACT: From the beginning of time, people wanted to support maritime trade. For this aim, subjets, merchants and transporters, required to have security for their merchandise or their ships, because there were large and very high sea risks. Searching this security, merchants started using some legal entities in order to protect them, until marine insurance was created. The most important of all them are bottomry contract and mutual society. During the research work, we are going to see the chronological development of these entities. Once marine insurance arised in the Mediterranean Sea, during the study we are going to talk about how these contracts were and the context and behaviour of the first legal texts in Spain. This legal texts range from “Ordenanzas de Barcelona de 1434”, the first one in the world about marine insurance, to “Ordenanzas de Bilbao de 1737”, the medium to draft our modern regulation
