Del sistema a la red: la perspectiva del juez.

Abstract

RESUMEN. El empeño por hacer del derecho un sistema fue inseparable de la propuesta de un juez maquinal. Pero al entusiasmo de los teóricos respondía el recelo de los jueces. Siempre fueron conscientes de que su actividad no podía ser meramente reproductora. Cada vez era más difícil mantener el ideal del sistema. La misma noción de sistema se ha ido diversificando y descomponiendo. Ahora, en nuestro tiempo post-sistemático, encontramos un derecho fragmentario y policéntrico. Las decisiones no son tanto consecuencias lógicas del sistema como distintos modos de activar las posibilidades del ordenamiento. El derecho, a medida que se desdibuja como sistema, se configura como red.

ABSTRACT. The purpose to convert law into a system was inseparable to the proposal of a mechanical judge. But the enthusiasm of professors was followed by the suspicion of judges. They knew that their activity couldn?t be merely reproductive. The ideal of a system was more and more difficult to support. The same notion of system became diverse and complex. Nowadays, in our postsystematic times we find a polycentric and fragmentary law. Decisions are not to view merely as logical outcomes of the system, but as different ways to activate law?s possibilities and chances. The system gets blurred and takes the form of a network.
