abstract = {El pasado día 11 de noviembre de 2019 la República de Gambia presentó una demanda judicial contra el Estado de Myanmar ante el Tribunal Internacional de Justicia (TIJ) por la violación de la Convención para la Prevención y la Sanción del Delito de Genocidio en atención a los hechos realizados contra la minoría rohinyá residente en Myanmar. Una medida internacional que refleja la gravedad y la dimensión del conflicto genocida que afecta a la población rohinyá. Un conflicto que se remonta a los orígenes del proceso histórico de conformación de lo que hoy en día es el actual Estado de Myanmar, antiguamente conocido como Birmania. El presente trabajo tiene por objetivo profundizar y estudiar este asunto que ha llegado hasta el TIJ. Nos ha interesado poder determinar la legitimidad de Gambia para presentar la demanda, pero, sobre todo, si realmente se han realizado actos de naturaleza genocida contra la población rohinyá y si es posible exigir responsabilidad internacional al Estado de Myanmar por estos hechos con la convicción de que las respuestas a estas cuestiones pueden tener un impacto más allá del caso concreto},
abstract = {On 11 November 2019, the Republic of Gambia filed a legal action against the State of Myanmar before the International Court of Justice (ICJ) for violation of the Convention on the Prevention and Punishment of the Crime of Genocide in relation to the acts carried out against the Rohingya minority residing in Myanmar. An international measure that reflects the gravity and dimension of the genocidal conflict affecting the Rohingya population. A conflict that dates back to the origins of the historical process of shaping what is now the current State of Myanmar, formerly known as Burma. The purpose of this paper is to explore and study this case that has reached the ICJ. We are interested in determining the legitimacy of the Gambia to bring the case, but, above all, whether acts of a genocidal nature have indeed been carried out against the Rohingya population and whether it is possible to hold the Myanmar state internationally responsible for these acts, in the conviction that the answers to these questions can have an impact beyond the specific case},
