abstract = {El presente trabajo tiene como objetivo principal el análisis de la figura del secreto profesional del abogado, entendido como uno de los pilares esenciales del derecho de defensa. Se trata de una garantía que protege la relación de confianza entre el abogado y su cliente, y que permite el ejercicio de la profesión de manera independiente y libre de injerencias. El trabajo examina la evolución histórica del secreto profesional, su naturaleza jurídica y su marco normativo actual, tanto en el ámbito nacional como en el internacional. Asimismo, aborda los principales límites y excepciones que pueden afectar a esta obligación de confidencialidad, prestando especial atención a los conflictos que se generan en contextos como la prevención del blanqueo de capitales o el cumplimiento de obligaciones tributarias.
A través de un enfoque basado en el estudio doctrinal, jurisprudencial y normativo, se identifican las tensiones actuales en torno a esta figura, y se reflexiona sobre la necesidad de encontrar un equilibrio adecuado entre la protección de los derechos fundamentales y las exigencias del interés general},
abstract = {The primary aim of this paper is to analyze the concept of attorney-client professional secrecy, understood as one of the fundamental pillars of the right to legal defense. It serves as a safeguard for the relationship of trust between lawyer and client, enabling the practice of law to be carried out independently and free from external interference. The study explores the historical evolution of professional secrecy, its legal nature, and its current regulatory framework, at both national and international levels. It also addresses the main limitations and exceptions that may affect this duty of confidentiality, with particular attention to tensions arising in contexts such as anti-money laundering obligations and tax obligations. Through an approach grounded in doctrinal, jurisprudential and legislative analysis, the paper identifies the current challenges surrounding professional secrecy and reflects on the need to strike a fair balance between the protection of fundamental rights and the demands of the public interest.},
