abstract = {La gestación subrogada, también conocida como maternidad subrogada, puede definirse como el proceso en el que una mujer, conocida como madre gestante, lleva y da a luz a un niño para otra persona o pareja que será el padre del niño tras el nacimiento. Este tema es altamente controvertido debido a las implicaciones éticas, morales y jurídicas que conlleva. Se trata de una práctica que suscita una indudable complejidad a nivel internacional por un lado debido al componente altamente internacional de esta práctica y el turismo reproductivo que se lleva a cabo y, por otro lado, la ausencia de un instrumento que armonice las legislaciones de los diferentes países.
