abstract = {RESUMEN: Este trabajo tiene por objeto mostrar al destinatario lo que es la gestación subrogada o gestación por sustitución con cada una  de  sus  modalidades.  La  maternidad  subrogada es un fenómeno que cada vez tiene más influencia  en España,  debido  a que  en otros  países está regulada y permitida la técnica, sin embargo, creemos que la gran mayoría de  la ciudadanía no es suficientemente consciente  de  ello,  puesto  que  como  en  España  es nula de pleno derecho, da la sensación de que no nos afecta, pero  no  es así. Entonces, este trabajo trata de enseñar, fundamentalmente, los problemas  con  los  que  se  encuentra  el  niño que nace mediante  esta  técnica,  cuando  el país  de origen de los  padres de intención  no ostenta regulación sobre la materia. También, por otro  lado, tratamos de indicar sugerencias para una futura regulación, para  aminorar  los  problemas  que  han  ocurrido  y que  siguen  acaeciendo.  Para   ello,   analizamos   resoluciones   de   organismos internacionales y de tribunales Europeos, así como las propuestas que se han  hecho  en España de cara a una futura regulación, con sus críticas correspondientes.

ABSTRACT: The purpose of this work is to show the recipient what is the Surrogacy or replacement pregnancy with each of its  modalities.  Surrogacy  is  a  phenomenon  that  has  more  and more influence in  Spain, because  in  other  countries  the  technique  is  regulated  and allowed,  however,  we  believe  that the  large  amount  of  citizenship  is  not   sufficiently aware of this, since as  in  Spain  is  null  and  void,  it  seems  that it  does not affect  us,  but it is not. So, this work tries to  teach, fundamentally, the problems that the child born through this technique finds, when the country of  origin  of  the  parents  of intention  does not have regulation on the  subject.  Also,  on  the  other  hand,  we  try  to  indicate suggestions for future regulation, to lessen the  problems that have  occurred  and  that continue to  occur.  To  do  this,  we  analyze  the  resolutions  of  international  organizations and European courts, as well as the proposals that have been made in Spain for future regulation, with their corresponding criteria.},
